1. Agreement to Terms

By accessing or using BuildClarity ("the Service"), provided by LNH CPA PLLC ("we," "us," or "our"), you agree to be bound by this End-User License Agreement ("EULA"). If you do not agree to these terms, do not access or use the Service.

2. Description of Service

BuildClarity is a financial visibility platform designed for construction contractors. The Service provides job profitability tracking, cash flow forecasting, overhead calculations, and financial insights. The Service is not accounting software, bookkeeping software, or tax preparation software. It is intended to provide financial clarity and operational intelligence.

3. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. This license does not include the right to sublicense, resell, or redistribute the Service.

4. Third-Party Integrations

The Service may integrate with third-party services including QuickBooks Online (provided by Intuit Inc.). By connecting your QuickBooks account, you authorize us to access your financial data solely for the purpose of displaying it within BuildClarity. We do not modify, delete, or create transactions in your QuickBooks account. Your use of third-party services is subject to their respective terms of service.

5. Data Privacy & Security

We take the security of your financial data seriously. All data transmitted between your browser and our servers is encrypted using industry-standard TLS encryption. We do not sell, share, or distribute your financial data to third parties. Access tokens for connected services are stored securely and can be revoked at any time by disconnecting the integration.

6. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to use the Service in compliance with all applicable laws and regulations. You acknowledge that the financial insights provided by the Service are informational in nature and do not constitute professional accounting, tax, or legal advice.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. FINANCIAL CALCULATIONS AND INSIGHTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR FINANCIAL DECISIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LNH CPA PLLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us.

10. Changes to This Agreement

We may update this EULA from time to time. We will notify you of material changes by posting the updated agreement on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.
